To run Ligno3D Designer in 'Activated Mode' this file must be included in the same directory as the program file for Ligno3D Designer ('Ligno3DD.exe').  The program is fully functioning only in Activated Mode.  Without this file Ligno3D Designer runs in Demonstration Mode.

To see the mode in which the program is currently running, select 'About Ligno3D' in the Help Menu.  The words 'Demonstration Mode' will appear in the resulting 'About Box' if the program is running in demonstration mode.  If activated, the words 'Serial Number', followed by a number of at least 5 digits, will appear instead.

END-USER LICENSE AGREEMENT FOR THE PC PROGRAM "LIGNO3D DESIGNER"

IMPORTANT, PLEASE READ THIS DOCUMENT.  THIS IS A LEGAL AGREEMENT BETWEEN YOU (AS AN INDIVIDUAL OR ORGANIZATION) AND LIGNO3D SYSTEMS.  BEFORE USING THE ACTIVATED FORM OF LIGNO3D DESIGNER YOU MUST ACCEPT THE TERMS AND CONDITIONS CONTAINED IN THIS LICENSE AGREEMENT.  THE ACTIVATED FORM OF LIGNO3D DESIGNER IS THE PROGRAM WHEN ACCOMPANIED BY AN ACTIVATION FILE (THIS FILE) PROVIDED BY LIGNO3D SYSTEMS.  BY USING THE ACTIVATED PROGRAM YOU ARE CONSENTING TO BE BOUND BY THE TERMS AND CONDITIONS HEREUNDER.

IF YOU ARE NOT WILLING TO BE BOUND BY THIS AGREEMENT AND YOU DO NOT AGREE TO ALL ITS TERMS AND CONDITIONS, DO NOT USE THE ACTIVATED PROGRAM.

COPYING OF THIS ACTIVATION FILE, EXCEPT AS PERMITTED UNDER THIS AGREEMENT, IS COPYRIGHT INFRINGEMENT UNDER THE LAWS OF YOUR COUNTRY.  IF YOU COPY THIS FILE WITHOUT LIGNO3D SYSTEM'S PERMISSION, YOU ARE VIOLATING THE LAW.  YOU MAY BE LIABLE TO LIGNO3D SYSTEMS FOR DAMAGES, AND YOU MAY BE SUBJECT TO CRIMINAL PENALTIES.

1. GRANT OF LICENSE.

Ligno3D Systems grants you a nonexclusive, non-transferable license to use the activated program on equipment owned by you or under your control, according to the terms and conditions of his License Agreement.

The following will also apply:

a. If you purchase a "Single User License" the activated program may only be used, except for demonstration purposes, by the person to whom the license is sold.  This person may install and use the program on more than one computer, provided other people do not use the program on any of these computers.  Furthermore, the activated program must not be run on more than one machine at any one time. Other people may use the activated program for demonstration purposes only in the presence of, and under the supervision of, the license holder.

b. If you purchase a "Multiple User License" the activated program may only be used by the organization to which the license is sold, and only on the organization's computers.  You may make copies of the activated program for use within the organization only up to the number of licenses purchased from Ligno3D Systems.  The activated program may be placed on a network provided that only your organization's computers have access to the program, and that only the number of licenses purchased, or fewer, can be run at any one time.

2. RESTRICTIONS:

You may NOT:

a. Copy the activated program except as permitted by this license.

b. Reverse-engineer, decompile or disassemble the program, activated or otherwise.

c. Distribute, rent, loan, lease, sell, sublicense or otherwise transfer all or part of the activated program, or any rights granted hereunder to any other person without the prior written consent of Ligno3D Systems.

d. Remove, alter or obscure any proprietary notices, labels or marks from the program, activated or otherwise.

e. Modify, translate, adapt, arrange or create derivative works based on the program for any purpose.

3. OBLIGATIONS.

Before purchasing a license to use the activated form of Ligno3D Designer you should download and evaluate the demonstration form. This will show you if the activated form of the program will work to your satisfaction on all machines on which you intend to use the program.  You should also print out the plans of an example object from the demonstration version to ensure that printing is satisfactory on all the printers you intend to use.

No royalty fees are required for the use of plans, images or any other data derived from the program. However, if any of these are to be used in any form of publication or product, including (but not limited to) web pages, books, public displays, etc, then you must give proper credit.  Proper credit includes the name of the program (Ligno3D Designer), the name of the company (Ligno3D Systems), and the company web site address (www.ligno3d.com).  In the case of web pages, proper credit should appear on each web page where any such data is used, with links to the program's home web page.  You should endeavour to keep these links up to date, as the program's home web page may change.  Objects that are created with the aid of the program and put on public display should also be properly credited.  Proper credit should be displayed in any documentation that accompanies the display.

4. UPGRADES.

You are entitled, at no extra cost, to minor upgrades, when and if they become available on Ligno3D Systems' web site (www.ligno3d.com).  A minor upgrade is where the version number changes after the decimal point - e.g., Version 3.11 to Version 3.32.  Download and install the upgrade from the website.  Your activation file (and any new '.lig', '.dxf' and '.bmp' files you have created) will not be overwritten during this process.  However, any '.lig' example files that were supplied with the original program, and that you have subsequently modified, will revert to their original state.  To be safe, you should back up the 'Ligno3D Designer' directory before attempting this.

5. COPYRIGHT.

Title and copyright to the program and activation file, and any copies made by you, remain with Ligno3D Systems. Unauthorized copying of the activation file or activated program, or failure to comply with the above restrictions, will result in automatic termination of this license, and possibly legal action.  You are free to copy and distribute the 'Ligno3DD.exe' file only if it is not accompanied by the activation file 'L3DDactive.rtf'.  The 'Ligno3DD.exe' file on its own constitutes the demonstration version of the program, which is freely distributable.

6. NO WARRANTY.

The program is provided to you "AS IS", and you acknowledge that it may contain errors.  LIGNO3D SYSTEMS disclaims any warranty or liability obligations to you of any kind.  LIGNO3D SYSTEMS MAKES, AND YOU RECEIVE, NO WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR IN ANY COMMUNICATION WITH YOU; AND LIGNO3D SYSTEMS SPECIFICALLY DISCLAIMS ANY OTHER WARRANTY INCLUDING THE IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.  LIGNO3D SYSTEMS DOES NOT WARRANT THAT THE OPERATION OF THE program WILL BE UNINTERRUPTED OR ERROR FREE.  The above exclusions may not apply to you, as some jurisdictions do not allow the exclusion of implied warranties.  In addition to the above warranty rights, you may also have other rights, which vary from jurisdiction to jurisdiction.

7. DISCLAIMER.

DUE TO AN INFINITY OF OBJECTS THAT CAN BE DESIGNED WITH THIS PROGRAM, THE PROGRAM HAS NOT BEEN TESTED IN ALL SITUATIONS IT MAY BE USED.  LIGNO3D SYSTEMS SHALL NOT BE LIABLE IN ANY MANNER WHATSOEVER FOR THE RESULTS OBTAINED THROUGH THE USE OF THE PROGRAM. PERSONS USING THE PROGRAM ARE RESPONSIBLE FOR THE SUPERVISION, MANAGEMENT AND CONTROL OF THE PROGRAM.  THIS RESPONSIBILITY INCLUDES, BUT IS NOT LIMITED TO, THE DETERMINATION OF APPROPRIATE USES FOR THE PROGRAM AND THE SELECTION OF THE PROGRAM AND OTHER PROGRAMS TO ACHIEVE INTENDED RESULTS.  PERSONS USING THE PROGRAM ARE ALSO RESPONSIBLE FOR ESTABLISHING THE ADEQUACY OF INDEPENDENT PROCEDURES FOR TESTING THE RELIABILITY AND ACCURACY OF ANY PROGRAM OUTPUT.

8. LIMITATION OF LIABILITY.

IN NO EVENT WILL LIGNO3D SYSTEMS BE CONSIDERED LIABLE FOR ANY LOSS OR DAMAGES OF ANY KIND, INCLUDING INJURY SUSTAINED WHILE MANUFACTURING OBJECTS DESIGNED WITH THE PROGRAM, LOSS OF DATA, LOST PROFITS, COST OF COVER OR OTHER SPECIAL, INCIDENTAL, CONSEQUENTIAL OR INDIRECT DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE PROGRAM, HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY.  THIS LIMITATION WILL APPLY EVEN IF LIGNO3D SYSTEMS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE. YOU ACKNOWLEDGE THAT THE LICENSE FEE REFLECTS THIS ALLOCATION OF RISK.
